Terms & Conditions

1. Bookings & Payment

The Property is made available to Guests for the period stated in your booking confirmation. Guests agree to not sublet or assign permission to occupy the Property or any part of it. Extensions are subject to availability and approval by Sydney Furnished Rentals.

An initial payment of $1,500.00, or the full value of the booking (whichever is less) is required to reserve the Property. Remaining balances are due 60 days before the commencement of the occupancy, unless this commences in less than 28 days of the booking in which case the balance is due within 48hrs.

Rental must be paid in full before access to the Property may be granted. Failing to pay an outstanding balance within the specified timeframe will result in the cancellation of the booking. In the event of the cancellation of the booking a refund is possible as per our Cancellation Policy.

Sydney Furnished Rentals accepts no liability for International direct deposit transaction costs that may be charged by the banks, please refer to your banking institution should you require more information.

 

2. Cancellation Policy

All Refunds are calculated in AUD less a $275.00 cancellation fee and any transaction costs. Refunds are reversed to the credit card or payee account (email us your initial transfer receipt) of the original transaction. We accept no liability for your foreign exchange or transaction costs.

Cancellation 35 or more days to commencement: Full refund, less administrative and transaction fees.

Cancellation 34 or less days to commencement: Pro-rata refund based on the number of nights successfully re-booked less administrative and transaction fees. If nights are re-booked at a lower value then the lower value will be refunded only. We will use best endeavours to re-let the property at the best rate to try and give you the maximum refund.

If we are unable to accommodate an amendment to the dates of stay such changes may be considered a cancellation for that booking and a new booking will be issued.

 

3. Security Deposits & Bonds

A security deposit of $1,200.00 must be provided by credit card transaction or authorisation prior to commencement of the occupancy;

a) Sydney Furnished Rentals has the authority to deduct any monies from the Security Deposit and/or make any additional charges to the credit card provided by the Guest to remedy any damage, excess cleaning, missing items, excess utilities caused by the Guests or Visitors, or to invoice the Guest by email, fax or post for immediate payment;

b)  Guests are advised that failure to comply with the Terms and Conditions may result in charges against the security deposit and/or additional charges to the credit card provided by the Guest; and

c)  Security deposits are administered, processed and accounted for and any balance is released or returned to the Guest as soon as possible following their departure in accordance with the applicable law.

 

4. License to occupy  

a)  Guests are granted a limited permission to occupy the Property for holiday purposes; 

b)  This is not a residential tenancy agreement under NSW residential tenancy legislation; and

c)  Failure to comply with the Guest's obligations in the Terms and Conditions may result in termination of permission to occupy the Property, eviction and extra charges for security and other expenses which may be deducted from Security Deposits or Bonds.

 

5. General obligations of Guests and Visitors  

Guests and Visitors must: 

a)  Comply with all House Rules and Strata By-Laws; 

b)  Respect the residential amenity and security of the Property and neighbours;

c)  Refrain from anti-social behaviour; 

e)  Comply with any instructions from the Manager and security services during their stay; and

f)  Notify the Manager of any disputes, complaints, damage and theft as soon as is practicable.

Guests must control and be responsible for Visitors and ensure that Visitors comply with the

House Rules and Strata By-Laws.

 

6. Noise and Residential Amenity

a)  Guests must not create noise which is offensive to neighbours especially between 10pm-8am and during arrival and departure at any time throughout the occupancy. 

b)  Offensive noise is prohibited and may result in: 

i. termination of permission to occupy the Property;

ii. eviction; 

iii. loss of rental paid; and 

iv. extra charges for security and other expenses which may be deducted from Security Deposits or Bonds. 

c)  Guests must abide by any noise abatement conditions, standards and orders issued by police or any regulatory authority to minimise impacts upon the residential amenity of neighbours and local community.

 

7. Number of Guests

The maximum number of persons that may be accommodated at the property is specified in your booking confirmation. Extra persons will be required to vacate the property or an additional charge may apply if appropriate bedding is available at the property at Sydney Furnished Rentals� discretion.

 

8. Functions and parties 

a)  The Property is not a �party house� and any such activities are strictly prohibited; and

b)  Any gathering, celebration or entertainment permitted at the Property must not conflict with residential amenity and must comply with all House Rules.

 

9. Access and Parking

a)  Guests and Visitors must only park in allocated spaces, comply with parking regulations and show consideration to neighbours. Specific parking instructions will be specified in your booking confirmation for Properties where parking is provided.

 

10. Recycling and Garbage

a)  Guests must dispose of garbage and recycling in accordance with the usual practice at the Property and in the allocated bins; 

b)  Guests must not leave excess rubbish in public or common areas;

c)  Guests should be co-operative in complying with requirements in relation to the relevant local council garbage and recycling collection days, and any special requirements relating to the disposal of garbage or waste minimisation.

d) Guests must remove all garbage and recycling from the Property upon vacating.

 

11. Complaints and dispute resolution procedure

a)  Guests are obligated to report any problems or incidents promptly; and 

b)  Our Complaints & Dispute Resolution Procedure can be found at the end of this document.

 

12. Liability

a) Guests are responsible jointly and severally for all loss and damage caused to the property and its fixtures, furniture and equipment during their stay and extra charges will be made for such loss and damage.

b) Guests agree to indemnify and keep indemnified Sydney Furnished Rentals and the Property Owner from and against all claims, demands, suits and expenses howsoever arising from or during the booking or occupancy of the property by any Guests or Visitors.

c) Sydney Furnished Rentals endeavours to describe the property and its position to the best of our ability and in good faith. No liability or damages will be accepted by us for mis-description.

 

13. Right to inspect the Property and re-enter the Property

Sydney Furnished Rentals has the right upon reasonable notice to inspect the property during the occupancy and at any time without notice if Sydney Furnished Rentals has reasonable grounds to believe that the property is being damaged or at risk or if the Guests or Visitors are breaching any term of this agreement or the House Rules.

 

14. Arrival, Departure, Keys & Lock Outs

Check-in is from 2pm on the Arrival Date. Guests must reconfirm the check-in and key collection time 48 hours to arrival. Photo ID & credit card details are required when collecting keys. Key collection outside of the hours 8am to 8pm will incur an additional fee of $66.00.

The property must be vacated by 10:00 am on the Departure Date, unless otherwise agreed in writing. Failure to depart on time will authorise Sydney Furnished Rentals to levy additional charges for rental and costs incurred.

Guests are responsible for keys (including access devices) and loss of keys and key/lock replacement costs will be charged to the Guest.

 

15. Cancellation by Sydney Furnished Rentals

In the unlikely instance that a property is withdrawn or otherwise unavailable, Sydney Furnished Rentals will endeavour to locate an alternative property of similar location and features, or offer a full refund at that time. If the Guest selects one of the alternative properties, a new booking will be created and funds will be transferred to the new booking. Any difference in the total charge will be refunded or additional payment by the Guest will be required.

 

16. Right of refusal

Sydney Furnished Rentals may refuse at its discretion to accept any Guest. Furthermore, Sydney Furnished Rentals may require that other Special House Rules be agreed to on arrival of the Guest.

 

17. Privacy and General Law

Sydney Furnished Rentals will not share your personal information with any third party, unless it is required to complete your booking, provide services to you, or settle your account. Please see our Privacy Policy for more details.

This Agreement is governed by the laws of New South Wales and Guests submit to the exclusive jurisdiction of the courts and tribunals of that state.

Any notice or communication must be in writing and delivered to the office of:  Sydney Furnished Rentals Pty Ltd during business hours Monday to Friday from 9am to 5pm, excluding public holidays.

 

18. Consequences of not abiding by the Terms and Conditions

a)  The consequences of not complying with the Terms and Conditions requirements can include enforcement action from the owner, Manager, security services, local councils or, in some instances, the Police.

b)  Enforcement action is subject to the Australian Consumer Law and other relevant legislation. 

c)  Such enforcement action could result in termination of permission to occupy the Property, eviction, loss of rental paid, deductions from security deposits and extra charges. 

d)  It is therefore important for all Guests to be aware of their obligations and of their responsibilities to make any Visitors to the Property aware of these requirements to maintain the amenity of the Property and its neighbourhood. 

 

Guest means a person who stays overnight in the Property during the term of the occupancy

Property means Dwellings and residential premises including houses, dual occupancies, villas, townhouses, apartments, units, secondary dwellings, cabins and the like generally with a maximum of 6 bedrooms unless the relevant local council permits holiday rental in properties with more than 6 bedrooms.

Sydney Furnished Rentals means the Owner or another person appointed by the Owner (such as a real estate agent), who is responsible for renting the Property.

Visitor means a person a Guest invites or permits to visit the Property during the term of the occupancy who does not stay overnight.

Holiday Rental means rental of Property for holiday purposes within the maximum term permitted for rental without a residential tenancy agreement under state and territory residential tenancy legislation.

Noise means any sound which is offensive to occupiers of neighbouring properties.

Owner means the person or entity who owns the Property. It includes the lessee of a Property who sublets or licences it to others for Holiday Rental.

 

House Rules

House Rules are provided for every Property to ensure that Guests and Visitors know and comply with the specific Rules governing their permission to enter and occupy the Property. House Rules specific to each property are made available electronically with booking confirmations and a copy is provided at the Property.

 

1. General requirements

a) Guest and Visitors must comply with all House Rules, By-Laws and instructions from the Manager and security services during their stay; and

b) Guests must notify the Manager of any disputes or complaints from neighbours as soon as is practicable.

 

2. Noise and Residential Amenity

a) Guests and Visitors must not create noise which is offensive to occupiers of neighbouring properties especially between 10pm - 8am and during arrival and departure at any time throughout the occupancy;

b) Offensive noise is prohibited and may result in termination of permission to occupy the Property, eviction, loss of rental paid and extra charges for security and other expenses which may be deducted from Security Deposit or Bond under the Terms and Conditions; and

c) Guests and Visitors must not engage in anti-social behaviour and must minimise their impact upon the residential amenity of neighbours and local community.

 

3. Visitors

a) Guests are responsible for ensuring the limits set on Visitor numbers is complied with at all times; and

b) Guests are responsible for ensuring that Visitors comply with these House Rules.

 

4. Gatherings or functions

a) The Property is not a �party house� and any such activities are strictly prohibited; and

b) Any gathering, celebration or entertainment permitted at a Property must not conflict with residential amenity and must comply with all the other requirements.

 

5. Parking

Guests and Visitors are to comply with parking regulations, show consideration to neighbours and other vehicles.

 

6. Garbage and recycling

Guests and Visitors are to dispose of garbage and recycling in accordance with the usual practice at the Property in the allocated bins, and excess rubbish must not be left in the Property, public or common areas.

 

7. Security

Whenever you are absent from the Property, securely close all windows and doors to maintain security and prevent rain and water damage.

 

8. Furnishings

The Guest may not remove any of the furniture or effects from the property and will be liable for any furniture or effects damaged or missing from the property. Furniture must be returned to its original position.

 

9. Smoking

Smoking is not permitted in the Property; de-odorising and additional cleaning charges will apply.

 

10. Utilities

Switch off lighting, air conditioning, heating, appliances and water to conserve resources and avoid damage.

 

11. Pets

Pets are not permitted in properties.

 

12. Damages, breakages, repairs

Damages breakages and required repairs must be immediately reported to the Manager.

 

13. Emergency Contact

In the event of an emergency relating to the Property, please telephone 1300 79 1105. If there is no answer or it is outside of office hours leave a voice message and a member of staff will respond promptly.

 

14. Compliance

a) Breach of these House Rules is a breach of the Terms and Conditions of occupancy.

b) The Owner and Manager reserve the right to terminate permission to occupy and to evict from the Property, Guests or Visitors who refuse to follow these House Rules or who cause a nuisance.

Complaints and Resolution Process

From time to time you may be unhappy with a product or service provided by Sydney Furnished Rentals or one of our Third Party suppliers. If you are dissatisfied with a product or service provided by us to you (a complaint) or if your complaint has not been effectively resolved when you bring it to Sydney Furnished Rentals attention (a dispute), then you must tell us promptly.

You may tell us by:

– Emailing us via our website at www.sydneyfurnishedrentals.com.au.

Each complaint or dispute is logged and assigned to the appropriate person to resolve.

We have 2 types of dispute resolution processes;
– internal dispute resolution process, and
– external dispute resolution process.

Both of the processes are free of charge for you to use.

Sydney Furnished Rentals internal dispute resolution process
If your complaint cannot be resolved at first contact, we will keep you informed of the progress and aim to give you a full response to your complaint within 10 business days. If the complaint is not resolved by that time, we will keep you advised at regular intervals of the status of your complaint. In all but exceptional cases we will take less than 45 days from receiving your complaint to complete our investigation. If we don’t, we will:
– inform you of the reasons for the delay,
– provide you with monthly updates on the progress of the investigation, and
– specify a date when a decision can reasonably be expected.

When we complete our investigation we will:
– advise you of the outcome, and
– advise you of our reasons for our decision with reference to any relevant provisions of the applicable terms and conditions.

Our external dispute resolution process
If you are not satisfied with our internal dispute resolution or the way we handle your complaint, you may refer it to the NSW Fair Trading. NSW Fair Trading safeguards the rights of all consumers and advises business and traders on fair and ethical practice. This service is available to you at no cost.
